1. Introduction

The “Mild n Wild” website accessed through www.mildnwild.co.za, is owned and operated by Mild n Wild (Pty) Ltd, Registration Number: 2019/306213/07 (“MnW”, “we”, “us”, or “our”). These terms and conditions (“Terms”) establish the legal agreement governing your use of our ecommerce platform www.mildnwild.co.za (the “Website”, “Site”) in any manner, by accessing, browsing, registering or making a purchase from our Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. Should you disagree with any part of these Terms, we kindly ask that you refrain from using our website.

2. Eligibility

Purchasing from our Site requires that you are at least 18 years of age. By placing an order, you affirm that you meet these requirements. If you are under the legal age, you may only use our Site under the direct supervision and consent of a parent or legal guardian, who assumes all responsibilities arising from your use and to be bound by these Terms.

3. Change to Terms

We reserve the right to amend, update, or modify these Terms and/or Privacy Notice at any time, with or without advance notice. Any changes will be effective immediately upon being posted on the Site. It is your responsibility to review these Terms regularly. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

4. Account Registration

To access certain Website features (including checkout, order tracking, and vendor tools), users are required to register for an account using accurate, complete personal information as requested.
You agree to provide accurate, current, and complete information during registration including your full name, email address, contact numbers (mobile and/or landline), physical address (billing and shipping address), and agree to keep your account details updated, including contact and delivery information.
Users are responsible for safeguarding their login credentials and for all activities conducted under their account. Please keep your password confidential, and do not share your account with others. If the User’s username and password are used, MnW is entitled to presume that any resulting actions and communications originate from the User. MnW will not be responsible for any loss or damage resulting from the unauthorised use of the User’s identification details.
Should you suspect unauthorized use of your account, notify us at info@mildnwild.co.za immediately; the compromised username and password will be deactivated as soon as reasonably possible. MnW will not be liable for losses incurred due to unauthorized access.
We reserve the right to restrict access, suspend or terminate your account at our sole discretion for any violation of these Terms or for any conduct detrimental to the Site or other users, including fraudulent activity, abuse of promotional codes, attempts to circumvent security measures or if a user uses the Website for unlawful purposes.

5. Product Information Allergens and Safety

We strive to display accurate and current information regarding our Products. However, we do not guarantee that product descriptions, images, pricing, or other content is complete, reliable, current, or error-free. Product weights and nutritional information are provided as guides and may vary depending on supplier or batch.
Our Products are produced in facilities that may process common allergens, including but not limited to peanuts, tree nuts and dairy. Cross-contamination is possible despite best practices and some of our products are not vegan.
We provide ingredient lists on product packaging. Users with allergies or sensitivities are responsible for reviewing this information before purchase or consumption.

6. Orders and Acceptance

By placing an order, you are making an offer to purchase Products in accordance with these Terms. All orders are subject to acceptance by us, and we reserve the right to limit or restrict orders at our discretion.
The products and prices shown on the Website are valid only while stocks last and depend on availability. The User acknowledges that all products listed on the Website are subject to limited stock. MnW will make reasonable efforts to monitor inventory levels and promptly remove any offers from the Website when stock is no longer available.
We reserve the right to refuse or cancel any order at any time for reasons including but not limited to product unavailability, errors in the description or pricing, or suspected fraud. If payment has already been made, a full refund will be issued to the original payment method.
Before finalising an order, Users will have the chance to review and, if necessary, amend their order details, including any information or addresses provided. MnW shall not be held liable for any loss, damage, delay, or other consequences resulting from errors made by the User in entering their information, address, or order details.
After receiving your order, MnW will send an acknowledgment via email. Order acceptance occurs only when we dispatch the Product(s) to you, at which point a contract is formed.
In the event that a Product is unavailable after you have placed an order, we will notify you and offer a suitable alternative, refund, or backorder option. You may also opt to receive notifications when out-of-stock items become available.
Product availability is subject to change, and we reserve the right to discontinue or modify Products and their prices at any time without prior notice.

7. Pricing and Payment

Prices are quoted in South African Rand (ZAR) and are inclusive of Value Added Tax (VAT) unless stated otherwise. The total price, including shipping costs and other fees, will be disclosed before you finalise your order. Prices may change due to fluctuations in supply, shipping costs, or regulatory changes. Before making a purchase, it is up to the User to confirm that the price of the product meets their expectations and approval.
We use a sufficiently secure payment system that complies with accepted technological standards to ensure that all transactions are secure and that those conducted via the Website are encrypted. The User acknowledges that transactions carried out over the internet are susceptible to interception. MnW cannot be held responsible for any loss incurred by the User as a result of such interception.
Online payments are facilitated by independent third-party payment service providers. MnW does not participate in, nor does it exercise control over, the payment services offered by these providers. To the maximum extent allowed by law, MnW disclaims any liability for any damage or loss that the User may experience as a result of the actions or omissions of these payment service providers, or from the User’s use of their services.
The prices shown for products on the Website are exclusive to items purchased via the Website. These prices do not apply to products sold by other retailers.
We accept several methods of payment including major credit cards, debit cards, and online payment services as listed at checkout. If a debit or credit card is used for payment, MnW may request further information to authorise and/or verify the validity of the transaction. MnW reserves the right to withhold delivery until all required information is provided and authorisation for the payment amount is successfully obtained. Should such authorisation not be received, the order for the products will be cancelled. The User confirms that they are fully authorised to use the provided debit or credit card for payment of the products and that sufficient funds are available on the card to cover all costs associated with the transaction conducted on the Website.
We reserve the right to change pricing or correct errors in pricing and Product Information at any time, even after an order has been placed. If a pricing error affects your order, we will contact you for confirmation before proceeding.
Upon successful payment, you will receive an order confirmation and invoice via email. Please review this documentation for accuracy and contact us immediately if you notice any discrepancies.
If payment is not processed by the relevant bank and credited to MnW’s bank account, the Consumer’s order will be cancelled immediately.

8. Promotional Coupons

Promotional coupons may be provided electronically at MnW’s exclusive discretion. By redeeming a Coupon, you agree to be bound by these Coupon Terms, as well as our general Terms and Conditions and Privacy Policy.
Coupons may be issued as part of promotional campaigns, newsletters, loyalty programmes, or other marketing initiatives at our discretion. Coupons are valid only for use by the recipient to whom they are issued and are non-transferable unless otherwise specified. Coupons are valid for a limited period, as stated on the Coupon or accompanying promotional materials. Expired Coupons will not be accepted.
Coupons can only be redeemed on the Website and are applicable to eligible products as specified in the promotion. To redeem a Coupon, enter the unique code at checkout prior to completing your purchase. Only one Coupon may be used per order unless otherwise stated. Coupons may be subject to a minimum purchase requirement, and certain products or categories may be excluded from the promotion. Coupons cannot be exchanged for cash, credit, or any other alternative, and are not valid for the purchase of gift vouchers, unless expressly stated.
Coupons may not be combined with other promotional offers, discounts, or coupons unless explicitly allowed in the promotion. Coupons are void where prohibited by law and may not be reproduced, resold, or traded. We reserve the right to cancel, modify, or suspend any Coupon or promotion at any time without prior notice, including in cases of suspected fraud, misuse, or technical errors.
If you return items purchased using a Coupon, the value of the Coupon will not be refunded or reissued. Refunds will be processed according to the price paid after the Coupon discount was applied. If a promotion is conditional on purchasing multiple items, and only some items are returned, the Coupon discount may be voided, and we reserve the right to adjust the refund accordingly.
We accept no liability for any loss, damage, or disappointment incurred as a result of using a Coupon or participating in a promotional campaign, except where such liability cannot be excluded by law.

9. Shipping and Delivery

We deliver goods to locations within South Africa only. Shipping and delivery timelines will be indicated during the checkout process and may vary depending on your location, courier availability, and product type.

Subject to stock availability, orders are typically processed within 2-3 business days from the date the full payment reflects. You will receive an order confirmation email once your order has been placed, and a shipping confirmation email with a tracking number when your order is dispatched.
Delivery times vary depending on your location and selected shipping method. In general, standard shipping within the country takes 3-7 business days, while expedited options are available for faster delivery.
Shipping fees are calculated based on the destination, weight, and size of your order. Any applicable fees will be displayed before you finalize your purchase at the checkout. Estimated delivery times are provided at checkout and may vary due to courier schedules, holidays, or unforeseen circumstances. Every effort is made to ensure that the delivery charges shown on the Website are accurate at the time of purchase. However, if a delivery fee is displayed incorrectly, MnW will not be obliged to deliver products at that incorrect rate. Should the User decide to cancel the purchase after being informed of the correct delivery fee, MnW will only be liable for refunding any payment already made by the User. Free delivery may be available for orders above a specified value, as indicated on the Site.
If your order is delayed, lost, arrives damaged or show signs of tampering, please contact our customer service team within 48 hours for assistance. We will investigate and work with the courier to resolve the issue. Replacement or refund policies for lost or damaged items are outlined in our Returns Policy. We are not liable for delays or losses resulting from events beyond our control, including but not limited to natural disasters, strikes, courier delays, or political unrest. Delivery times are estimates and not guarantees.
The User agrees that, upon delivery of their order, they may be required to present a valid form of identification and commits to providing such identification when requested.
Please ensure that your shipping address (Physical Address) is complete and accurate as MnW does not verify the accuracy of the delivery address provided by the User. We will not deliver any products to postal addresses, e.g. (P.O. Box address). We are not responsible for any costs, loss, damages or claims incurred due to incorrect address information provided by the User. Risk of loss and title for Products pass to you upon delivery to the specified address. The User must ensure that someone will be available at the delivery address between 08h00 and 17h00 on business days (Excludes Saturdays, Sunday and Public Holidays). If no one is present at the designated delivery address to receive the order, the courier will retain the products and notify the User of the attempted delivery. The courier will then coordinate with the User to schedule a new delivery date and time. Should there be any additional charges incurred due to the User’s unavailability to accept the delivery or if the courier returns the products to MnW as a result, the User will be responsible for those fees.
MnW aims to deliver orders within the timeframe shown on our Website. However, larger orders, order quantities, longer distances, or other factors may cause delays. Users will be informed of any expected delays, and any revised delivery times will replace those stated in confirmation emails or invoices.

10. Cancellations & Returns

The User is entitled to cancel an order at any time, as long as the cancellation occurs before MnW dispatches the order for delivery. Once the products have been delivered by MnW to the User, returns are only permitted in accordance with the terms set out in our returns policy.
If you are not satisfied with your purchase, you may request a return of unopened products within seven days of receiving your order, provided that the product is unused, in original packaging, and include all original tags and accessories for a refund or exchange. Product availability may affect exchange options. Due to the perishable nature of our Atchars, Pickles, Sauces and Condiments, Users are kindly requested to store these products in the fridge until the shipping company collects them. Final sale products, custom or personalized goods cannot be returned or exchanged and opened items cannot be returned for hygiene reasons.
To start a return or exchange, contact our customer service team via email with your order number, the item(s) you wish to return, the reason for return or exchange and photographic evidence if applicable. We will guide you through the process. Original shipping fees are non-refundable, except in cases where we shipped the wrong item or the item was defective/damaged. We may ask you to return the affected items in their original packaging, or we may arrange for replacement or refund at our discretion.
Once we receive and inspect your returned item(s), we will notify you of our approval or rejection. We reserve the right to request additional information or deny returns or refunds if the Products show signs of use, tampering, or are returned outside the specified window. Approved returns will be reimbursed for the purchase price paid by the User for the product, excluding any applicable delivery costs and/or charges to your original payment method within 30 days however we will try our best to process the refund quicker. This period covers the time required for MnW to receive the return shipment from the User, the processing time for MnW once the return is received, and the duration needed for the User’s bank to complete the refund transaction.
The User will be responsible for the costs of returning the products to MnW. We recommend using a trackable shipping service or purchasing shipping insurance for returns, as we cannot guarantee receipt of your returned item. The User bears the risk of loss or damage to the products until MnW has received them.
Items returned that do not meet the above criteria or that have not been authorized by our customer service team may not be eligible for a refund or exchange.
If you have not received a refund after the processing period, please double-check your bank account and contact your payment provider. If you still need help, reach out to our customer service team.
No section of these Terms relating to MnW’s cancellation and returns policy shall override or be construed to limit any of the Consumer’s non-waivable statutory rights, where applicable. If and to the extent that the Consumer Protection Act, 2008 (“CPA”) applies, Consumers have the right to return products with material defects in accordance with the provisions of the CPA.

All Products purchased from our Site are intended for personal, non-commercial use only. Bulk purchases for commercial purposes require prior written approval and may be subject to different terms.
Resale or redistribution of Products without our written consent is strictly prohibited. We reserve the right to limit quantities or deny service to suspected commercial buyers.
It is your responsibility to check ingredient lists, nutritional information, and allergen statements before consumption. We are not liable for adverse reactions arising from the use or misuse of Products purchased from us. Please consult a healthcare professional if you have allergies or dietary restrictions.
Products should be stored as per instructions provided on the packaging or Site to maintain freshness and safety.

In the event of a dispute, users are encouraged to contact our customer support team for prompt resolution. All complaints will be acknowledged within 2 business days and a substantive response provided within 10 business days.
Parties agree to attempt to resolve disputes amicably before seeking formal legal recourse however if disputes cannot be resolved internally, they may be referred to the Consumer Goods and Services Ombud, the National Consumer Commission, or other appropriate regulatory bodies.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary or severed, so that the remaining provisions remain in full force and effect.

23. Entire Agreement

These Terms of Use, together with our Privacy Policy and any additional terms posted on the Site, constitute the entire agreement between you and Mild n Wild (Pty) Ltd concerning your use of the Site and purchase of Products. No waiver of any provision shall be deemed a waiver of any other provision or of the same provision at a future date.

MnW and the User each designate the addresses listed next to their respective names below as the addresses for receiving all notices and other communications related to these Terms, as well as their domicilium citandi et executandi (“Domicilium”) where all legal documents pertaining to these Terms should be served.

MnW as per clause 25 below and the User according to the address provided by the User during registration on the Website or when placing an order through the Website, as applicable.

Any notice or communication required or allowed under these Terms will only be valid and effective if it is in writing and delivered to the party’s designated address as specified in clause 26. However, documents relating to legal proceedings under these Terms may be served only at a party’s Domicilium.
